Abstract
In this annual review chapter, William S. Jordan III surveys significant developments in federal administrative adjudication during 2013. The chapter focuses on judicial decisions, agency reforms, and regulatory trends that shaped the due process landscape in administrative hearings. Jordan discusses evolving procedural protections in both formal and informal adjudications under the Administrative Procedure Act (APA), with attention to fairness, transparency, and the limits of agency discretion. Key topics include ALJ independence, the standards for evidentiary decision-making, due process concerns in adjudicatory settings, and the continuing tension between efficiency and procedural rigor. The chapter also touches on significant adjudicatory activity in areas such as immigration, securities, and health care. Jordan’s analysis offers a comprehensive update for scholars and practitioners on how adjudication is functioning across the modern administrative state.
