Abstract
In this article, Ainslee Johnson-Brown examines the ethical and legal responsibilities of prosecutors in ensuring respectful and accurate language when interacting with transgender individuals in the criminal justice system. The author argues that misgendering and the refusal to use preferred pronouns can constitute prosecutorial misconduct and may infringe upon constitutional protections. The article discusses the implications of such practices on victims, jurors, and defendants, and emphasizes the importance of inclusive language in upholding justice and equality.
