Abstract
This article addresses the often-overlooked legal question of how, and to what extent, a trustee who is not the settlor can be held accountable for trust administration during the settlor’s lifetime when the trust is revocable. Newman explores the Uniform Trust Code’s provisions and the interplay between fiduciary duties and the revocability of the trust. He argues that the presence of a non-settlor trustee complicates the traditional view that beneficiaries have limited rights while the trust remains revocable, advocating for clearer guidance on accountability and oversight in these scenarios.
